Historically, certain vulnerable people who lack the mental capacity to understand or retain information or make decisions based on that information, have been legally deprived of their liberty so that they can receive care or treatment that is in their best interests. The Deprivation of Liberty Safeguards were introduced in 2009 to ensure that this deprivation of liberty continues to be in the person's best interests.
Relevant Person's Representatives are a key part of this safeguarding process, particularly where it is not appropriate for a family member or friend of the person to take on this responsibility.
